Team Removals New Zealand - Terms & Conditions

1. For the purposes of these terms and conditions:

- **“Act”** means the Contract and Commercial Law Act 2017.

- **“Team Removals”** means Team Removals Limited.

This contract is made between **Team Removals Limited** (“the Movers”) and _______________ (“the Customer”). All business undertaken by the Movers, including the provision of any advice, information, or other services, is undertaken upon and subject to these conditions.

**1. Acceptance of Goods**

1.1. Team Removals Limited accepts goods for carriage only upon these terms and conditions:

For all house/office moves, furniture relocation, and general freight movement, where prices are quoted based on information provided by the customer, Team Removals Limited reserves the right to modify prices if there are discrepancies in the volume, dimensions, weight, Packing or access conditions (e.g., stairs, balconies) differing from the information provided at the time of booking. Additional charges may be incurred for redirection, multi-route moves, additional labor, storage, etc.

1.3. An extra charge may apply for heavy or oversized items such as spa pools, pianos, pool tables, or any other similar commercial items. It is the customer's responsibility to inform Team Removals Limited if the move includes such items.

1.4. If the Movers deem any goods unsafe to transport or insufficiently packaged, they reserve the right to reject the acceptance of such goods.

1.5. The company reserves the right to change, reschedule, delay, or cancel the customer’s job due to unforeseen circumstances without waiving any charges. In the event of a delay exceeding two hours, the customer will be informed, and a mutual decision will be made at the company’s discretion.

1.6. The Customer shall not provide any of the following items to Team Removals Limited for packing, removal, or storage:

- Dangerous, corrosive, inflammable, explosive, or damaging substances, or any items likely to encourage pests.

- Jewellery, watches, precious stones, metals, money, deeds, securities, stamps, coins, or similar valuables.

- Prohibited or stolen goods, drugs/medicines, aerosols, paints, firearms, or ammunition.

- Refrigerators or deep freezers containing goods (customers are responsible for emptying, defrosting, and cleaning).

- Animals, including pets, birds, or fish.

1.7. The Customer must notify Team Removals Limited of any access restrictions to the property from which goods are to be removed. The Customer is responsible for providing adequate and safe access for the truck and movers. If there are access restrictions, additional charges may apply.

**2. Insurance and Liability**

2.1. **No Insurance Coverage Provided by Team Removals Limited**

Team Removals Limited does not provide any insurance coverage for the goods being moved. It is the responsibility of the Customer to arrange for insurance coverage, if required. The Movers will not be held liable for any loss or damage to goods unless such loss or damage is caused intentionally by the company.

2.2. The Customer acknowledges and agrees that the removal is at the owner's risk, and the Movers will not be liable for loss or damage to any goods except in cases where the loss or damage is caused by the Movers’ negligence or intentional action.

Goods are covered by Carriers Liability Insurance during transit, subject to the terms of the Carriage of Goods Act 1979. This insurance is free for the customer but has limitations, including:

- Damage to goods caused by an accident during transit.

- The Customer must contact their own insurance provider for more comprehensive coverage.

- Claims must be submitted within 24 hours of the occurrence of damage or loss, and only after full payment has been received.

2.4. The following items are excluded from liability:

- Items with pre-existing damage or inherent damage.

- Owner-packed goods, including glass or fragile items, electrical appliances such as television , or factory-packed goods.

- Third-party damage (if another party is at fault in the event of an accident, the customer must file a claim with the other party’s insurance).

Special Items (Pianos, Musical Instruments, etc.): If a special item, such as a piano, is moved without any external damage, we are not liable for internal issues, such as tuning problems or other operational defects that arise after the move.

We are not liable for damage caused by atmospheric conditions such as humidity, temperature changes, rain, snowfall, or other extreme weather events.
A) This covers circumstances where wood becomes discolored or blackened due to moisture from humidity or rain. As we have no control over these environmental factors, such damage is not covered under our liability.
B) Furthermore, if unfavorable atmospheric conditions—such as heavy rain, snowfall, storms, or extreme heat—are present and we proceed with the move at the customer's request, we will not be liable for any damage to goods, whether they are bundles, cartons, or furniture that may be affected by the weather.
C) Additionally, adverse weather may cause delays, restricted access, or additional handling challenges, and these complications will not be considered grounds for compensation.

Natural Damages (Grass, Landscaping, etc.): We are not liable for damage to grass, plants, or landscaping caused by the move. Such damage can often recover over time and is considered natural. This includes any minor scuffing or wear to outdoor surfaces that may occur.

While we take utmost care in handling and transporting your belongings, Team removals will not be held liable for any minor scratches, scuff marks, or surface damage that may occur during transit or while maneuvering items. Such occurrences are inherent risks in the moving process and depend on various factors, including the weight, size, and shape of the item being moved, access conditions such as narrow staircases, doorways, hallways, or tight spaces, the surface type and fragility of the flooring, walls, or goods, and the complexity of the move, including enclosed spaces and restricted maneuverability. While our team exercises professional care and expertise, certain unavoidable marks or minor damages may occur due to the nature of the move. By booking our services, you acknowledge and accept this as part of the moving process.

If a customer raises a complaint via email and does not respond for one month after our initial conversation, the complaint will be automatically closed. Complaints will not be entertained beyond this period, and no further claims will be considered

**3. Payment Terms**

3.1. All residential and non-credit account moves are payable via cash, cheque, or credit card on the same day of move unless pre-arranged with management. Commercial office moves may allow up to 7 days credit as per the comment while

3.3. Payment is required prior to unloading the final item(s), and a late fee of $50.00 + GST will apply for any overdue payments.

3.4. Defaulting accounts will be sent to a third-party debt collection service at the Customer’s expense.

**4. Misconduct and Unacceptable Behavior**

4.1. Any misconduct or unacceptable behavior directed at any member of the Team Removals Limited staff may result in the termination of the booking at the company's discretion.

**5. Cancellation Policy**

5.1. A cancellation fee of $150.00 applies unless a minimum of 48 hours’ notice is given via email.

5.2. For same-day cancellations, a fee equivalent to 2 hours of the scheduled service will be charged.

These terms and conditions are subject to change and are governed by the **Contract and Commercial Law Act 2017**.
